If you were or are a client of The Law Offices of Lucas Magazine who, on or after April 27, 2016, and before September 8, 2023: (a) entered into a funding agreement with, or sold an interest in your legal claim to, Momentum Funding, LLC; and/or (b) repaid Momentum Funding, LLC for funding previously obtained, you could get a payment from a class action settlement.

  • The settlement resolves a lawsuit with the The Law Offices of Lucas Magazine, LLC, James Magazine, Elizabeth Magazine, Momentum Funding, LLC, and Jeff Lucas for legal malpractice, breach of fiduciary duty, and violations of Florida’s Deceptive and Unfair Trade Practices Act.
  • THE SETTLEMENT PROVIDES FOR A RELEASE OF CERTAIN CLAIMS OF CLASS MEMBERS AGAINST LUCAS MACYSZYN & DYER LAW FIRM, PLLC, JAMES MAGAZINE, JEFF LUCAS, ELIZABETH MAGAZINE, AND MOMENTUM FUNDING LLC AND A PERMANENT INJUNCTION PROHIBITING CLASS MEMBERS FROM BRINGING LAWSUIT BASED UPON RELEASED CLAIMS IN THE FUTURE. (See paragraph 7 below).
  • The settlement will provide a Settlement Fund and a mechanism to pay claims for clients who entered into a funding agreement with or sold an interest in their legal claims to Momentum Funding LLC or repaid such funding during the period from April 27, 2016, to September 8, 2023.
  • Court-appointed lawyers for the former clients will ask the Court for up to one third of the Settlement Fund for fees, in addition to requesting reimbursement of their advanced costs and expenses, for investigating the facts, litigating the case, and negotiating the settlement.
  • The two sides dispute liability and whether class action treatment is appropriate and disagree on how much money could have been awarded if the current or former clients won at trial and how much would have been available from the Defendants to pay the former clients’ claims.
